The organizations on the list have return due dates between May 17 and October 15, 2010, but the IRS has no record that they filed the required returns for any of the past three years.&lt;br /&gt;&lt;br /&gt;“We are doing everything we can to help organizations comply with the law and keep their valuable tax exemption,” IRS Commissioner Doug Shulman said. “So if you do not have your filings up to date, now’s the time to take action and get back on track.”&lt;br /&gt;&lt;br /&gt;Two types of relief are available for small exempt organizations — a filing extension for the smallest organizations required to file Form 990-N, Electronic Notice, and a voluntary compliance program (VCP) for small organizations eligible to file Form 990-EZ, Short Form Return of Organization Exempt From Income Tax.&lt;br /&gt;&lt;br /&gt;Small organizations required to file Form 990-N simply need to go to the IRS website, supply the eight information items called for on the form, and electronically file it by October 15. That will bring them back into compliance.&lt;br /&gt;&lt;br /&gt;Under the VCP, tax-exempt organizations eligible to file Form 990-EZ must file their delinquent annual information returns by October 15 and pay a compliance fee. Details about the VCP are on the IRS website, along with frequently asked questions.&lt;br /&gt;&lt;br /&gt;The relief announced today is not available to larger organizations required to file the Form 990 or to private foundations that file the Form 990-PF.&lt;br /&gt;&lt;br /&gt;The IRS will keep today’s list of at-risk organizations on IRS.gov until October 15, 2010 which can be found by Clicking Here. Please note that this is an incomplete list, as there may be entities out there that need to comply but are not found at that link. Organizations that have not filed the required information returns by that date will have their tax-exempt status revoked, and the IRS will publish a list of these revoked organizations in early 2011. Donors who contribute to at-risk organizations are protected until the final revocation list is published.&lt;br /&gt;&lt;br /&gt;The Pension Protection Act of 2006 made two important changes affecting tax-exempt organizations, effective the beginning of 2007. First, it mandated that all tax-exempt organizations, other than churches and church-related organizations, must file an annual return with the IRS. The Form 990-N was created for small tax-exempt organizations that had not previously had a filing requirement. Second, the law also required that any tax-exempt organization that fails to file for three consecutive years automatically loses its federal tax-exempt status. The IRS conducted an extensive outreach effort about this new legal requirement but, even so, many organizations have not filed returns on time.&lt;br /&gt;&lt;br /&gt;If an organization loses its exemption, it will have to reapply with the IRS to regain its tax-exempt status. They can instead amend their 2009 tax returns to claim the credit and receive it sooner.&lt;br /&gt;&lt;br /&gt;Buyers who purchased in 2009 and didn't claim the credit on their 2009 returns can also amend those returns to get the credit.  Recently we have been asked which documents our clients must prepare in order to claim the credit on either an original 2009 return or on an amended 2009 return:&lt;br /&gt;&lt;br /&gt;First-time homebuyer&lt;br /&gt;&lt;br /&gt;•A copy of the settlement statement showing all parties' names and signatures, property address, sales price, and date of purchase. Normally, this is the properly executed Form HUD-1, Settlement Statement.&lt;br /&gt;    &lt;br /&gt;•For mobile home purchasers who are unable to get a settlement statement, a copy of the executed retail sales contract showing all parties' names and signatures, property address, purchase price and date of purchase.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;•For a newly constructed home where a settlement statement is not available, a copy of the certificate of occupancy showing the owner’s name, property address and date of the certificate.&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Long-time residents&lt;br /&gt;&lt;br /&gt;Long-time homebuyers claiming the credit for buying a new principal residence must show that they lived in their old homes for a five-consecutive-year period during the eight-year period ending on the purchase date of the new home. The IRS has stepped up compliance checks involving the homebuyer credit, and it encourages homebuyers claiming this part of the credit to avoid refund delays by attaching documentation covering the five-consecutive-year period:   &lt;br /&gt;&lt;br /&gt;•Form 1098, Mortgage Interest Statement, or substitute mortgage interest statements,&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;•Property tax records or&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;•Homeowner’s insurance records.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The IRS says it's not necessary to have five years of the same documentation. Any combination of these documents verifying that you owned and lived in your home as a principal residence for at least five consecutive years is acceptable.&lt;br /&gt;&lt;br /&gt;For example, suppose you owned and lived in your previous home from Nov. 1, 2004, to Oct. 31, 2009. Tax amnesty information, including a Tax Information Publication and Tax Amnesty Agreement form, is available on Revenue's website at www.myflorida.com/dor/amnesty.&lt;br /&gt;&lt;br /&gt;Why take advantage of Florida's tax amnesty period? Taxpayers can:&lt;br /&gt;•Significantly reduce the interest that is due, up to 50 percent.&lt;br /&gt;•Pay no penalty.&lt;br /&gt;All Department of Revenue (DOR) administered taxes due before July 1, 2010 are covered during the amnesty period except unemployment taxes and the Miami-Dade County Lake Belt fees. An amnesty agreement form must be submitted to the department to participate.&lt;br /&gt;&lt;br /&gt;Taxpayers who identify a tax liability unknown to Revenue will be required to pay only half as much interest as they would if DOR found the unpaid tax later. If DOR already identified the tax liability in a bill, jeopardy assessment, or other assessment, or had already scheduled an audit, the taxpayer is eligible for a one-fourth reduction in interest charges. In addition, taxpayers will receive a complete waiver of penalty under tax amnesty. This credit modifies the existing Hope credit for tax years 2009 and 2010, making it available to a broader range of taxpayers. Income guidelines are expanded and required course materials are added to the list of qualified expenses. Many of those eligible will qualify for the maximum annual credit of $2,500 per student.&lt;br /&gt;&lt;br /&gt;In many cases, the American Opportunity Credit offers greater tax savings than existing education tax breaks. Here are some of its key features:&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Tuition, related fees and required course materials, such as books, generally qualify. In the past, books usually were not eligible for education-related credits and deductions. &lt;/p&gt;&lt;ul&gt;&lt;li&gt;&lt;br /&gt;The credit is equal to 100 percent of the first $2,000 spent and 25 percent of the next $2,000. That means the full $2,500 credit may be available to a taxpayer who pays $4,000 or more in qualified expenses for an eligible student.&lt;br /&gt;&lt;/li&gt;&lt;li&gt;The full credit is available for taxpayers whose modified adjusted gross income (MAGI) is $80,000 or less ($160,000 or less for filers of a joint return). The credit is reduced or eliminated for taxpayers with incomes above these levels. These income limits are higher than under the existing Hope and lifetime learning credits.&lt;br /&gt;&lt;/li&gt;&lt;li&gt;Forty percent of the American opportunity credit is refundable. This means that even people who owe no tax can get an annual payment of the credit of up to $1,000 for each eligible student. Existing education-related credits and deductions do not provide a benefit to people who owe no tax. The refundable portion of the credit is not available to any student whose investment income is taxed, or may be taxed, at the parent’s rate, commonly referred to as the kiddie tax. See IRS Publication 929, Tax Rules for Children and Dependents, for details.&lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;Though most taxpayers who pay for post-secondary education qualify for the American Opportunity Credit, some do not. The limitations include a married person filing a separate return, regardless of income, joint filers whose MAGI is $180,000 or more and, finally, single taxpayers, heads of household and some widows and widowers whose MAGI is $90,000 or more.&lt;br /&gt;&lt;br /&gt;There are some post-secondary education expenses that do not qualify for the American Opportunity Credit. They include expenses paid for a student who, as of the beginning of the tax year, has already completed the first four years of college. The bill included revenue raising provisions meant to seek greater compliance of the tax code via 1099 information reporting. General provisions included:&lt;br /&gt;&lt;br /&gt;-  The elimination of the corporate exemption from 1099-MISC reporting. (Public Law 111-148)&lt;br /&gt;&lt;br /&gt;-  The requirement to report payments for property (goods, materials, merchandise, supplies, etc.). (Public Law 111-148)&lt;br /&gt;&lt;br /&gt;-  A six-fold increase in penalties from $250,000 to 1.5 million. (H.R.4213, H.R.4849)&lt;br /&gt;&lt;br /&gt;- A doubling of penalties per record from $50 to $100. (H.R.4213, H.R.4849)&lt;br /&gt;&lt;br /&gt;Beginning for payments made after December 31, 2011, companies will be required to furnish and file form 1099-MISC for payments made to all for-profit companies regardless of corporate status. In addition all payments for goods, materials, merchandise, supplies, and other property will need to be reported as well. Due to the weakened economy, people have the fear of losing everything, but the smart business owners see unadulterated potential for growth.  It is not about the amount you spend; it is about knowing where to spend it. There are innovative resources emerging daily. Most of these untapped resources cost little or NOTHING to implement.  In this blog entry we are going to help you locate some of these inexpensive resources, such as bartering, staffing, and providing great customer service.&lt;br /&gt;&lt;br /&gt;Bartering seems a bit out-dated. If you are reading this, you already know how fast technology is changing. We used to phone and fax. Then, we e-mailed and instant messaged. Now, we are blogging, tweeting, social networking and texting. Our firm has just embarked on an aggressive update of our website(s) to integrate these and other functions to better serve you, our clients and potential clients.&lt;br /&gt;&lt;br /&gt;The website design is engineered to be a central reference point for our firm that integrates all the above-mentioned technologies. The website(s) will allow you to sign-up for (e-)mailings, receive text updates and reminders, follow this blog and twitter. It will also integrate social networking through Facebook and Linkedin. Further, the site will include updated news feeds that you may subscribe to, if so desired. Not only will we integrate these new technologies, we will update and integrate the "best" functions of our current website(s).&lt;br /&gt;&lt;br /&gt;We will also be using some of our client's and our favorite functions from our previous website versions. "Pay your Bill," tax resources, tax calendars, calculators, subscribe to our (e-)newsletter, send us your files and "Ask us" function will live on. These functions allow us to provide more efficient and effective communication and service for all our clients. Furthermore, integration with our new technologies will provide quite an enhancement that I'm sure you will appreciate.&lt;br /&gt;&lt;br /&gt;As the world moves forward, so must we. We are truly excited about the website design and see great potential and benefits. We hope this investment will make the communications and services that we provide to you, our most valued clients, more efficient and effective.&lt;br /&gt;&lt;br /&gt;Please continue to monitor this blog and please subscribe. So, our first post should tell you what has brought us here and what we intend to do with it.&lt;br /&gt;&lt;br /&gt;First, we have to thank all of our clients for allowing us the opportunity to be a part of their business and personal financial focus. They are truly the backbone of our organization! From the questions they ask to the challenges they face in these economic times, our clients are the primary focus of our firm. We are sharpened and shaped every single day in providing tax, bookkeeping, payroll, auditing and business consulting services to our clients.&lt;br /&gt;&lt;br /&gt;Second, our staff. Without the assistance, knowledge and technical abilities of our staff, we would not be afforded the many opportunities that we enjoy, including writing this blog.&lt;br /&gt;&lt;br /&gt;We are establishing this blog to share important information with our current and potential clientele. We will include articles, video, commentary and possibly even a cartoon here and there. Our objective is to "Help you See Through the Numbers." Whether you are a business or individual, we want to help guide you through the plethera of financial and tax information available on the interenet, professional journals and blogoshere. And, since we are somewhat techies, we want to introduce some of the technology behind the numbers. Since we all like a deal, if we find a sale on something, like, say "QuickBooks on Sale for $59," we will pass that information along as well.&lt;br /&gt;&lt;br /&gt;What we won't do on this blog is politcize the information contained therein. Our commentary and yours should be factual, contextual, and respectable.
